Position Summary:

Provide accurate and timely advice to internal Alerus teams such as retirement, health and welfare, wealth management, investment advisory, sales and plan development teams. Provide advice on a variety of legal topics that relate to the business sector and their products or services.

Essential Responsibilities:

Job Function 1: Provide accurate, relevant and timely advice to ARB Staff, including the sales and plan development teams, on a variety of legal topics that relate to the business sector and their products or services, particularly on ERISA and the U.S. Tax Code - 70%
  • Work with ARB Staff to draft proposed communications (emails, white papers or memos) to plan sponsors or participants regarding changes in the law impacting retirement or health and welfare benefits.
  • Consult with ARB Staff regarding plan design for existing and new business.
  • Consult with ARB Staff in the event of employer or Alerus administrative or processing errors.
  • Prepare and review all administrative forms, participant notices and disclosures.
  • Work with Alerus IT and web development staff regarding legal notices, disclosures and electronic communications with plan participants.
  • Draft, negotiate and modify service level, custodial and trust agreement templates for ARB, including the Health and Welfare division.
  • Review of ARB vendor contracts for new subcontractors. Draft or review of contracts controlling ARB business ventures and new product development.

Job Function 2: Promote legal, compliance and risk management best practice throughout ARB. Manage and mitigate legal and compliance risks by designing and implementing policies and procedures for ARB - 25%
  • Communicate with and manage external counsel. In addition, serve as lead liaison with regulators on ARB matters.
  • Stay up-to-date with changes to laws, rules and regulations that directly affect ARB, its business and the retirement and benefits industry. Provide written communications to ARB Staff and ensure that ARB processes and procedures are modified, if necessary, to address such changes.

Job Function 3: Staff Management/Training - 5%
  • Conduct weekly meetings with the ARB legal and compliance teams to identify issues and recommend policy involving plan administration, new product offerings and sales efforts.
  • Design and deliver legal training, primarily via webinars, to ARB Staff on relevant legal and compliance topics.

Position Requirements:

Qualifications:
  • JD Degree.
  • Good standing in applicable state bar.
  • Experience working with the administration of retirement plans, health and welfare plans and the provision of ERISA fiduciary advice.
  • In depth understanding of ERISA and the U.S. Tax Code.
  • Excellent contract drafting and written communication skills.

Personal Characteristics:
  • Strong interpersonal and presentation skills, along with the ability to communicate effectively with others at all levels of the organization.
  • Strong negotiating skills with both legal and financial/commercial issues.
  • Ability to establish and maintain strong relationships within the organization's legal department and across all businesses.
  • Ability to work independently with little or no supervision.

Physical Demands: (must be met with or without a reasonable accommodation)
  • Extended periods of time sitting at a desk and using office equipment.
  • Ability to operate a personal computer/laptop for approximately 8 hours per day.
  • Extended time is spent reviewing physical and electronic documents.
  • The employee is occasionally required to stand, walk, reach with arms and hands, climb or balance, and to stoop, kneel, crouch or crawl. Vision abilities required by this job include close vision.
  • Periodically, may also do light lifting of supplies and materials which weighs in at approximately 20 lbs.
  • Will spend most of time in an indoor environment.
